Breach of
Release Conditions

A breach charge should begin with the exact condition the accused is alleged to have violated—not a general impression that they failed to follow bail. Compass Law represents clients facing release-condition allegations in Mississauga and across the GTA. No-contact terms, curfews, geographic boundaries, residence requirements, abstinence clauses, reporting duties, and other restrictions all operate differently, making the wording of the order, proof of knowledge, timing, location evidence, communications, and any lawful excuse central to the case.

One word in a release condition can determine whether the alleged conduct was actually prohibited

A condition may prohibit direct contact, direct or indirect contact, attendance at a location, being within a distance, leaving a residence during certain hours, or consuming a substance. Those are not interchangeable restrictions.

Digital evidence frequently drives breach allegations. Calls, messages, location data, social media, surveillance, and screenshots may show contact or presence but still require accurate attribution, timestamps, and context.
Accidental encounters can create difficult factual questions. Seeing a protected person unexpectedly in a store or public place is different from deliberately arranging contact, especially where the order contains specific exceptions or wording.

Proof that the accused knew the condition also matters. The release document, explanations given at release, signatures, amendments, and whether several overlapping orders existed may all require review.
THE DEFENCE

A breach case turns on the exact condition and the exact conduct.

01
Read the operative release document and identify the precise words said to have been breached.
02
Confirm the accused had notice of that version of the condition at the relevant time.
03
Verify timestamps, authorship, location data, and context behind digital evidence of alleged non-compliance.
04
Distinguish deliberate prohibited conduct from accident, ambiguity, mistaken identity, or a recognized exception.

Common Questions About Breach of Release Conditions

Yes. Non-compliance with specified release conditions can lead to a separate criminal allegation and may also affect the accused's release status.

That does not necessarily permit a response. If the accused is subject to a no-contact condition, the wording remains binding until it is lawfully changed.

The circumstances and wording of the condition matter. Where contact was genuinely unexpected, what happened afterward may become important.

Potentially. Location evidence may be relevant, but accuracy, device ownership, timestamps, collection methods, and what the data actually proves should be examined.
