Drug-Impaired Driving

Drug-impaired driving investigations can involve cannabis, prescription medications, illegal substances, or combinations of drugs and alcohol. Compass Law defends these allegations for clients in Mississauga and across the GTA. Because drug cases can rely on physical symptoms, roadside testing, drug recognition evaluations, bodily-fluid samples, laboratory analysis, prescription history, and police interpretation of behaviour, the evidentiary picture can be materially different from a conventional alcohol-impaired driving case.

Drug impairment cannot always be reduced to a single reading or one observed symptom

Officers may document eye movement, speech, balance, divided-attention performance, pulse, coordination, driving behaviour, or other observations. The significance of those signs can depend on training, procedure, medical conditions, fatigue, anxiety, and other explanations.

Some investigations proceed to a drug recognition evaluation or laboratory testing. The timing of consumption and testing, type of substance, prescription information, sample handling, and relationship between detected drugs and alleged impairment can become important.
Canadian law includes both impairment-based offences and offences involving prescribed blood-drug concentrations. These are not interchangeable, so identifying the exact charge is essential before deciding what evidence matters most.

A defensible analysis may need to connect toxicology with real-world behaviour rather than treating either one in isolation. Medical information and the reliability of police observations can be particularly significant where symptoms have more than one plausible cause.
THE DEFENCE

Where drug-impaired driving evidence deserves closer scrutiny.

01
Compare alleged impairment symptoms with medical, prescription, fatigue, anxiety, or other possible explanations.
02
Check whether roadside and drug recognition procedures were performed consistently with required protocols.
03
Examine laboratory results alongside sample timing, continuity, substance type, and the specific offence charged.
04
Review the legal basis for every demand, detention, bodily sample, and investigative step.
