Internet / Child
Luring Charges

Child luring investigations are built around electronic communication and the purpose police attribute to it. Compass Law represents clients facing internet luring charges in Mississauga and across the GTA. These files can involve undercover officers, social media profiles, dating or messaging applications, seized phones and computers, forensic extractions, usernames, IP information, search warrants, age representations, and lengthy chat histories that must be reviewed before isolated messages are interpreted as criminal intent.

Digital investigations can preserve every message while still leaving intent open to interpretation

Police may enter an online conversation using an undercover identity and preserve the exchange from beginning to end. That creates a detailed record, but the legal question still concerns what the accused intended to facilitate through the communication.

Age representations can change during an exchange. What the person communicating believed about age, when they acquired that belief, and how the conversation developed afterward may be central to the allegation.
Device attribution is another separate issue. A forensic extraction may show that messages existed on a device, but account ownership, shared access, usernames, login history, and control of the device still need to be established.

Search warrants frequently generate the evidence used beyond the initial chat. The grounds for searching a residence or device, scope of the authorization, and manner of forensic examination can raise distinct Charter issues.
THE DEFENCE

Digital intent must be proven from the evidence, not inferred from a label.

01
Track every representation about age and identify exactly when the accused allegedly became aware of it.
02
Read the communication chronologically to determine what criminal purpose the prosecution says it demonstrates.
03
Separate account identity, device possession, and actual authorship rather than treating them as interchangeable.
04
Review warrants and forensic searches for scope, legal foundation, continuity, and Charter compliance.
