Youth Bail
Hearings

Youth bail is not simply adult bail with younger participants. The Youth Criminal Justice Act imposes additional limits on detention and requires release conditions to account for a young person's actual ability to comply. Compass Law represents youth clients at bail hearings in Mississauga and across the GTA, developing plans around residence, parents or responsible adults, school attendance, counselling, structured activities, safety concerns, and conditions that protect the process without setting the young person up for unnecessary breaches.

Youth Criminal Offences

A youth release plan should be realistic enough for a teenager to follow every day

The YCJA restricts when detention can be ordered and incorporates Criminal Code bail principles subject to youth-specific rules. The seriousness of the charge alone does not automatically determine whether a young person remains in custody.

Conditions imposed on youth must satisfy statutory requirements including necessity, reasonableness, and the young person's realistic ability to comply. A condition that looks protective on paper can create avoidable breach risks if it is impractical.
Family support may play a substantial role. Residence, transportation, school schedules, parental work hours, counselling, and supervision arrangements should be concrete rather than described in vague promises.

The plan should also preserve stability where possible. Continuing education, employment, sports, cultural activities, counselling, and other structured commitments can be relevant when they form part of a workable release arrangement.
THE DEFENCE

Youth bail conditions should be necessary, reasonable, and realistically achievable.

01
Build the release plan around the young person's actual home, school, transportation, and supervision arrangements.
02
Challenge conditions that are too complex or unrealistic for the young person to comply with consistently.
03
Use parents or responsible adults purposefully where their support genuinely addresses identified bail concerns.
04
Preserve constructive education, employment, counselling, and community routines wherever the release plan permits.
